Terms and conditions of business

About these terms
These terms apply when you send coins, medals, tokens or banknotes ("items") to Numistacker Numismatic Services Ltd ("NNS", "we", "us") for grading, conservation or any related service. NNS is registered in England and Wales, company number 12927768, registered office Unit 201, 2nd Floor Metroline House, 118-122 College Road, Harrow, HA1 1BQ. VAT number GB 378 4105 81. Our working address is Unit 3, Strata House, 34a Waterloo Road, London NW2 7UH.
We are an authorised dealer of Numismatic Guaranty Company (NGC) and submit your items to NGC, to Paper Money Guaranty (PMG) for banknotes, and to Numismatic Conservation Services (NCS) for conservation. NGC, PMG and NCS are independent companies. We do not grade, conserve or authenticate items ourselves, and every grade, attribution, designation and conservation decision is theirs alone.
These terms, our privacy notice and the declaration you give when you submit form the agreement between us. The version in force on the day you submit an order applies to that order. When we publish a new version we will tell you, show it to you when you next sign in or submit, and ask you to accept it before your next submission. Every version, with the date it took effect, stays available in the Terms section of your account.
Your account
You submit and manage orders through your Numistacker account. Please keep your details, including your address, accurate: your address decides how your items come back and whether VAT applies (see 9.6).
Keep your sign-in details private. You can add two-step verification in your account settings, and we recommend it. Tell us straight away if you think someone else has used your account.
Some features (your collection, showcases, rewards and auction consignments) are optional. Where a feature has its own terms, you accept them separately when you start using it.
Submitting your items
You can submit in four ways:
When you submit, you confirm that:
Post your items to us securely and fully insured. Items are at your risk until we receive them. We cannot accept responsibility for a parcel that does not reach us.
When your items arrive we check them against your listing. If an item is not as listed (a different item, date, denomination or value, or it needs a different tier, holder or service), we correct the listing and record the reason. You can see the change and the reason in your account.
If our corrections raise the price of your order by more than £40 or 20% (whichever is greater), we will not submit the affected items until you have approved the new price in your account. We will email you when we need your approval.
We may decline to submit an item (for example, one the grading company will not accept), and we will tell you if we do.
Services, tiers and prices
Our prices are shown in our published price list. The price list in force on the day you submit applies to your order and does not change afterwards for that order.
Each item goes to the tier that suits its type, and whose value limit covers your declared value. If you declare a value above a tier's limit, the item moves up to a tier that covers it. We never silently move an item down.
Grading companies charge a minimum per submission form. Our standard service shares forms between customers, so you pay only your own item fees.
XTRA gives you your own submission forms and tier numbers, with no other customer's items on them. XTRA is charged per item and per form, as shown in the price list, and your forms carry the grading company's minimum form fee. Photo services (such as Internet Imaging and PhotoVision Plus) need XTRA and apply to the whole tier.
Options such as special labels, designations (for example First or Early Releases), VarietyPlus, Mint Error, Pedigree, holder upgrades (XXL, oversize, thick), metallurgic analysis and return packaging are charged as shown in the price list.
A grading company may move an item to a different tier after grading, for example because it values the item higher than declared. If it does, we pass on the price difference. Where the grading company's actions mean extra administration for us (a tier change, a renumbered submission or a moved item, for example), we may make a handling charge, typically between £1.50 and £5.00 per item.
Where we have agreed a discount with you, it applies as agreed and appears on your invoice.
Declared value, insurance and liability
For each item you choose whether to insure it. Insurance covers loss of, or damage to, the item up to its declared value while it is with us and while it is at the grading company. The premium is a percentage of the declared value, set in the price list, and is shown separately on your invoice.
If you do not insure an item, you carry the risk of its loss or damage, except where we are responsible under 5.3.
We are liable for the loss of, or damage to, an item only where it is caused by our negligence while the item is in our direct possession. In that case we will compensate you up to the item's declared value, whether or not you insured it.
Toning, tarnish, haze, spotting and patina are natural processes, not damage. They can develop, particularly on silver and copper, while an item is away for grading, even if it looked clear when you sent it. We cannot accept liability for them, or for any change in market value they cause.
If an item is damaged while at the grading company, we will take the matter up with them and do our best to reach a fair resolution for you, but the outcome depends on the grading company's own terms.
How far an item's return journey is covered depends on the return method (see section 10). Royal Mail Special Delivery covers a parcel to £2,500 at most. If your items in a Royal Mail parcel are worth more than £2,500 in total, the value above £2,500 travels at your risk, even if you paid for insurance.
Nothing in these terms limits any liability that the law does not allow us to limit, including your statutory rights as a consumer.
Crossover and ReHolder
Crossover sends an item already graded by PCGS to NGC, to be re-graded into an NGC holder. We can only accept PCGS holders for crossover. For each crossover item you must give its current PCGS grade and certificate number.
For each crossover you choose the lowest grade you will accept:
The + and ★ marks are not taken into account. If NGC would give a lower grade than you accept, the item stays in its PCGS holder. Designations such as First Strike are not carried across.
NGC charges its tier fee for a crossover whether or not the item crosses.
ReHolder puts an item already in an NGC holder into a new NGC holder. For each item you give its existing NGC certificate number. ReHolder is priced by the item's value and holder size, as shown in the price list.
Conservation
You can ask for conservation when you submit an item, or accept an offer of it. We offer conservation when NGC identifies your item as one NCS could improve.
When we make an offer, we email you, and you choose "conserve" or "no thanks" in your account before the deadline shown, normally within 12 hours. We send a reminder before the deadline. If we have not heard from you by the deadline, we treat the offer as declined. We never send any item to NCS while any offer on its submission is still waiting for an answer.
NCS charges an evaluation fee of £4 plus VAT for each item considered for conservation, whether or not it is conserved. Where conservation is carried out, NCS's fee is charged as shown in the price list. Conservation fees are invoiced after your items return from NGC, on a separate conservation invoice, and must be paid before your items are sent back to you.
Asking for conservation does not oblige NCS to carry it out. Requests for crossovers, holdered items and modern coins graded 69 are sometimes refused. Banknotes are not conserved.
Conservation adds time: allow about 30 days longer than grading alone.
Grading results and problem items
A grade is the grading company's opinion, and we cannot change it. If you disagree with a grade, we can send the item back for review or regrade, which the grading company charges at its standard tier fee for the item. We pass that fee on.
A "mechanical" error is the grading company's mistake, for example a wrong label, attribution or denomination, or a damaged holder. We send the item back to the grading company to put right at no charge to you, and return it to you free.
If the grading company treats a claimed mechanical error as a regrade and charges for it, we may pass that charge on. It is limited to the tier fee, any holder and token or medal surcharge, and insurance if you chose it, and never includes a form minimum. We will tell you before we charge it.
Grading companies sometimes renumber a submission or move an item to a different tier. When they do, we update your order to match and tell you about any change in price.
Invoices and payment
We invoice your grading once your items have reached NGC. The invoice lists your items and the services and options you asked for.
After grading you may receive an additional invoice or a credit note, for example for:
Invoices are due 7 days after the invoice date, unless we have agreed other terms with you.
You can pay:
If an invoice is unpaid, we send reminders on the due date, then 7 days and 14 days after it. After 21 days we will contact you directly. A payment we have not yet matched to your invoice (for example a PayPal payment) may not stop a reminder being sent. Please ignore a reminder for an invoice you have already paid, or contact us.
VAT follows where your items are delivered:
If we do not have your address, we charge UK VAT until you give us one, and we then recalculate the VAT before invoicing. Once an invoice is issued, any later change is made by a further invoice or a credit note.
We return your items only once every invoice for them has been paid in full. If you overpay, we refund the difference or, if you prefer, keep it on your account.
Returning your items
DHL insured courier is our standard return method, and the one we recommend. You can choose another method, and the charges are shown in the price list:
Postage is normally charged once for your return. If your items come back in more than one shipment, we may charge postage for each shipment.
You can ask us to change the return method at any time before your items are dispatched. If you have already been invoiced, the difference is charged or credited.
Your capsules are returned or disposed of, as you chose when you submitted.
We tell you when your items are dispatched, and give you the tracking details.
Cancelling
You can cancel an order yourself, in your account, until we receive your items.
After we have received your items, you can ask for them back at any time until we have packed them to send to the grading company. We will return them to you. Any grading invoice is cancelled, or refunded if you have paid it. Return postage may be charged, and we may also charge a service fee for the work already done, depending on the situation.
Once your items have been sent to the grading company, the order cannot be cancelled. The items come back to you only when grading is complete.
Your collection, showcases, rewards and consignments
Your collection lets you record your items, and add items by NGC or PMG certificate number. You can publish showcases, each set as private, unlisted (visible only to people you give the link to) or public. Visitors to a showcase never see your values, your notes or your name. You are responsible for what you choose to publish.
The rewards scheme, when offered, has its own terms, which you accept when you join.
Consigning items to auction through us is covered by a separate consignment agreement, which you accept for each consignment.
Your information
We use your personal information as described in our privacy notice. It is in the Terms section of your account.
We send you service emails about your orders and invoices. We send marketing only if you have asked to receive it, and you can change this at any time in your account.
You can download a copy of the information we hold about you from your account. We prepare it in the background and email you when it is ready.
Closures, contact and the law
We may close for holidays or for events. Any closure is shown in your account in advance, and we will warn you if a parcel would arrive while we are closed.

These terms are governed by the law of England and Wales. If you live elsewhere in the United Kingdom, you may also bring proceedings in your local courts.

About this declaration
You give this declaration each time you submit an order to Numistacker Numismatic Services Ltd ("NNS", "we", "us"). It goes with our terms and conditions of business, and the terms' own numbering is used below where a point is explained there. The version in force on the day you submit applies to that order.
When our staff enter an order for you, for example when you hand us items at a show, this declaration applies to those items in the same way, as our terms explain (3.1(d)). We record that the order was entered by us and why, and that you did not tick it yourself.
Your items
You declare that:
You will tell us when you submit if you know or suspect that an item is not genuine, or has been cleaned, repaired, re-toned, tooled or otherwise altered.
Descriptions and declared values
You declare that your description of each item is accurate to the best of your knowledge, and that each declared value is your honest estimate of what the item is worth.
You understand that the declared value decides the item's tier and fee, and, for an item you insure, the cover and its premium (terms 4.2 and 5.1). An item is never covered for more than its declared value.
You understand that when your items arrive we check them against your listing, and may correct an item that is not as listed and re-price it (terms 3.4). If that raises the price of your order by more than £40 or 20% (whichever is greater), we will ask you to approve it before we go on (terms 3.5).
Insurance and risk
You have chosen, for each item, whether to insure it. You understand that an item you do not insure is at your own risk, except where its loss or damage is caused by our negligence while it is in our direct possession (terms 5.2 and 5.3).
You understand that your items are at your risk until we receive them, so you will post them to us securely and fully insured (terms 3.3).
Grading, conservation and timing
You understand that your items will be sent outside the United Kingdom: to NGC or PMG in the United States, or to NGC in Munich where you choose it, and to NCS if they are to be conserved. They will be away for several weeks, and any time we give is an estimate, not a promise.
You understand that a grade, and every decision about conservation, is the grading company's own opinion, which we cannot change (terms 1.2 and 8.1).
Charges
You agree to pay the charges for your order, as shown in our published price list on the day you submit, together with any charges that follow from grading, such as a change of tier made by the grading company or conservation you accept (terms 4.6 and 9.2).
You understand that we return your items only once every invoice for them has been paid in full (terms 9.7).

Who we are
This notice explains how Numistacker Numismatic Services Ltd ("NNS", "we", "us") uses your personal information when you use our website, your Numistacker account and our grading services. We are the controller of that information under UK data protection law.

The information we hold
Your account: your name, email address, phone number, the addresses you give us (including state or county), your country, whether you collect or trade, and any forum or Numisearch name you give us. If you add them, your nickname and profile picture.
Your sign-in: your password, which we store only in a scrambled form we cannot read back; your two-step verification set-up, stored encrypted; and, for each time you sign in, the date, your IP address and the type of device and browser you used.
Your orders: the items you submit and their descriptions, declared values, insurance choices, pedigree and provenance as you state them, the documents and photographs you or we attach, tracking details, the grades and certificate numbers that come back, and the declarations and terms you accepted, with the date and the IP address you accepted them from.
Money: your invoices, credit notes and payments, how you paid, and payment references. We never see or store your full card number: card payments are made on Stripe's own secure page.
Messages: the messages you send us through your account, and email replies you send to our messages.
Your collection and showcases, if you use them: the items you record, your notes, and any purchase or sale details you choose to add, including who you bought from or sold to; the photographs you upload; and your showcases and the settings you choose for them. Photographs taken on a phone can carry hidden details, such as where the photograph was taken. We do not use those details, and your own photographs are never shown in a showcase.
Marketing and cookie choices: which updates you have asked to receive, when and how you told us, and the cookie choices you make on our website.
Rewards and consignments, if you join or consign: your rewards balance and history, and the details of any items you consign to auction through us.
How you use your account: the days on which you use your account, which helps us keep it secure and understand how it is used. With your consent (see section 9), we also count which parts of the account are used; the note that links that count to you is deleted at the end of each month.
Our own notes: our staff may keep notes and tasks about your account and orders, and we keep a record of changes made to your account and orders and by whom.
Where it comes from
Most of it comes from you: when you register, submit an order, write to us or use your account.
Some comes from our staff, for example when they enter an order for you or record a payment, and some from the grading companies, whose grades, certificate details and images are added to your order and collection.
If you were our customer before your Numistacker account was opened, we created your account from our own earlier records: our courier address book, our accounts system and our order records. We then invited you to take over the account.
Payment details come from Stripe, from our accounts system and from our bank when you pay us.
Why we use it, and our legal basis
To carry out our contract with you (or to take steps you ask for before one): to run your account, take in, check, submit, insure and return your items, deal with the grading companies on your behalf, invoice you, take payment, answer your messages and run the optional features you choose to use.
To meet our legal obligations: to keep accounting and VAT records, and to answer lawful requests from the authorities.
For our legitimate interests, where these are not outweighed by your own interests and rights:
With your consent: marketing emails if you are not an existing customer, optional cookies, and counting how the account is used. You can withdraw your consent at any time, without affecting what we did before.
We do not make decisions about you by automated means that have legal or similarly significant effects on you. Tiers and prices follow from the choices and values you give, and our staff check every order.
Who we share it with
The grading companies, NGC, PMG and NCS, receive your items and, for each item, its description and declared value. The submission is in our name, so they are not given your name or contact details. Certificate details they publish online describe the item, never its owner.
The companies that help us run our service, each only for that purpose and under contract with us:
Couriers and Royal Mail, which receive your name, delivery address and phone number to deliver your items.
Auction houses, only if you consign items to auction through us. Unless you agree otherwise, the auction house is not told who you are.
Our professional advisers, and HMRC, the police, courts or other authorities where the law requires it or allows it to protect our rights.
If you publish a showcase, visitors see the items in it and the description you give it, never your name, your values, your notes or your own photographs (unlisted showcases only to people you give the link to).
We do not sell your information, and we do not share it with anyone for their own marketing.
Outside the United Kingdom
Your items, with their descriptions and declared values, go to the grading company in the United States, or to Germany if you choose NGC Munich.
Some of the companies in 5.2 are based in, or use, other countries, including the United States. Where your information is transferred outside the United Kingdom, we rely on the UK government's adequacy decisions or on the safeguards UK law provides, such as the International Data Transfer Agreement or Addendum. Files you upload are stored in the European Union.
How long we keep it
We keep your account information while your account is open.
We keep your orders, invoices, payments and the correspondence about them for six years after the end of the financial year in which your last order ended, because the law requires us to keep accounting and VAT records and because they may be needed for a claim. If you close your account, we keep these records for the same time.
Some information is kept for shorter periods:
At the end of these periods we delete the information, or remove anything that identifies you.

You have the right to:
To use any of these rights, contact us as in 1.3. We may need to confirm your identity first. We will answer within one month, and it is free unless a request is plainly unfounded or excessive.
You can stop marketing emails at any time, with the unsubscribe link in each email or in your account's settings. Emails about your orders and invoices are part of our service and are always sent.
Cookies
Our website and your account use a small number of cookies and similar storage that they need to work, such as keeping you signed in. We use optional ones, such as remembering your display choices or counting how the account is used, only if you agree. You can change your choices at any time with "Cookie settings" at the foot of any page. Our cookies page lists each one.
Keeping it safe
Your account is protected by your password, which we store only in scrambled form, and by two-step verification if you turn it on (we recommend it). Everything you send us travels encrypted. Our staff sign in through a separate, secured system, only staff who need your information can see it, and changes they make are recorded.
Children
Our services are for adults. We do not knowingly open accounts for anyone under 18.
Complaints
If you are unhappy with how we have used your information, please tell us first, and we will do our best to put it right. You also have the right to complain to the Information Commissioner's Office (ico.org.uk, 0303 123 1113).
Changes to this notice
When we change this notice we will publish the new version in the Terms section of your account, with the date it took effect, and tell you about any important change. Earlier versions stay available there.
Previous versions
Every version that is no longer current, each showing exactly the words it always did.
